1. Ownership and Use of Site 

1.1. The Site and all content and materials on the Site, including but not limited to text, graphics, logos, images, software, and audio and video files (collectively, "Content"), are the property of APL Cargo or its licensors and are protected by intellectual property laws.

2. Prohibited Conduct

2.2. You may not copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any Content without the prior written consent of APL Cargo. 
2.3. You may not use any automated means to access the Site or Content, including but not limited to robots, spiders, scrapers, or other automated tools. 
2.4. You may not interfere with or disrupt the operation of the Site or servers or networks connected to the Site. 
2.5. You may not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.

3. Links to Third-Party Sites 

3.1. The Site may contain links to third-party websites or resources. APL Cargo provides these links for your convenience only and does not endorse or make any representations about the content or accuracy of such third-party sites. 
3.2. You acknowledge and agree that APL Cargo is not responsible or liable for any content, advertising, products, or other materials on or available from such third-party sites or resources.

4. Disclaimer of Warranties 

4.1. THE SITE AND CONTENT ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. 
4.2. APL CARGO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 
4.3. APL CARGO DOES NOT WARRANT THAT THE SITE OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

5.  Limitation of Liability 

5.1. APL CARGO SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE, ARISING FROM YOUR USE OF THE SITE OR CONTENT, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES. 
5.2. APL CARGO'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

6. Indemnification 

6.1. You agree to indemnify and hold harmless APL Cargo from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the Site or Content, or your breach of these Terms.

7. Amendments 

​7.1. APL Cargo may amend these Terms from time to time by posting the amended Terms on the Site. Your continued use of the Site after such amendment will constitute your acceptance of the amended Terms.

8. Termination

8.1. APL Cargo reserves the right to terminate your access to the Site or Content at any time and for any reason, without prior notice. 
8.2. Upon termination, you must immediately cease all use of the Site and Content.

9. Governing Law and Jurisdiction 

9.1. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which APL Cargo is incorporated. 
9.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

10. Entire Agreement 

10.1. These Terms constitute the entire agreement between you and APL Cargo regarding your use of the Site and Content and supersede all prior or contemporaneous negotiations, discussions, or agreements between you and APL Cargo, whether written or oral.

11. Cookies and Tracking

APL Cargo Inc. may use cookies and other tracking technologies to improve the client and carrier experience on our website and to collect analytics data. Clients and carriers may adjust their browser settings to control or disable cookies and tracking.

12. Children's Privacy

APL Cargo Inc. does not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete the information as soon as possible.

13. Complaints

Clients and carriers may file a complaint with Freight Sync's Privacy Officer if they have concerns about the handling of their personal information. We will investigate all complaints and take appropriate action to address any issues raised.

14. Confidentiality

APL Cargo Inc. considers all personal information collected from clients and carriers to be confidential and will only use it for the purpose for which it was collected.

15. Data Protection

APL Cargo Inc. takes reasonable measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. We have implemented technical and organizational measures to ensure the security of personal information.

 16. Data Breach Notification

APL Cargo Inc. will notify clients and carriers in the event of a data breach that could result in the unauthorized access, disclosure, or loss of personal information. We will take immediate steps to mitigate any damage and will cooperate with regulatory authorities as necessary.

 17. Data Retention

APL Cargo Inc. will retain personal information only for as long as necessary to fulfill the purpose for which it was collected or as required by law.

18. Data Subject Rights

Clients and carriers have the right to access, correct, and delete their personal information, as well as the right to restrict or object to its processing. APL Cargo Inc. will comply with all applicable data subject rights requests.

19. Accountability

APL Cargo Inc. is committed to accountability for the protection of personal information. We have designated a Privacy Officer to oversee our privacy program and ensure compliance with applicable privacy laws and regulations.

20. Training and Awareness

APL Cargo Inc. provides regular privacy training and awareness programs to all employees and contractors to ensure that they understand their obligations and responsibilities with respect to personal information.

21. Marketing Communications

APL Cargo Inc. will only send marketing communications to clients and carriers who have provided their consent to receive such communications. Clients and carriers may withdraw their consent to receive marketing communications at any time.

22. Third-Party Service Providers

APL Cargo Inc. may engage third-party service providers to assist us in providing transportation services or other support services. We will only share personal information with third-party service providers who have agreed to protect the confidentiality and security of personal information.

23. Interpretation
